摘　　要：全国人大常委会《关于司法鉴定管理问题的决定》主要规范的是司法鉴定管理体制问题,对于刑事诉讼制度中司法鉴定启动权配置的问题仍然未有明确的规定。在《决定》出台后刑事诉讼中仍存在的司法鉴定启动权配置的问题和弊端的基础上,对刑事诉讼中司法鉴定启动权改革进行一定的完善。＂The Decision on the Management of Judicial Expertise＂ made in the Standing Committee of the National People＇s Congress aims at the problems about management system of forensic science. But the Decision has not made clear the problem of the starting right＇s distribution of forensic science in criminal procedures. The reform of the starting right of forensic science in criminal procedures should be improved on the basis of analyzing the problems and the drawbacks of the starting right＇s distribution of forensic science in criminal procedures after the Decision coming into effect.
