摘　　要：人权是作为人应该享有的权利,标志着人的生存与发展的状态,并为宪法提供了一个不断演进的逻辑基础和逻辑过程,同时也是人的生存和发展的宪法学表达。因此,人权既是宪法的逻辑基点,也是宪法的价值归宿。明确这点对于理解宪法概念和价值具有重要的理论和实践意义。Human rights are the rights everyone should enjoy as a citizen, which mark the subsistence and development of human beings, provide an evolving logical process for the constitution, and act as the constitutional expression of the subsistence and development of human beings. Therefore, human rights are not only the logical point of the constitution, but also the final destination of the constitution.
