摘　　要：在介绍商业秘密与反竞争情报相关概念的基础上,从组织、流程、制度、技术、企业文化等5个层面,对基于商业秘密防护的反竞争情报体系的构建进行了探讨,并以力拓间谍案为例,分析其中企业针对商业秘密保护的反竞争情报体系构建中存在的问题和建设性意见。Based on the introduction of some relevant concepts of business secrets and counterintelligence, this paper discusses the construction of enterprise counterintelligence system based on the protection of business secrets from five aspects of the organization,system,process,technology and enterprise culture, and taking the RioTinto spy case as an example,analyzes the problems existing in the process of the construction of counterintelligence system,and proposes some constructive comments.
