摘  要:转租是以转租人与出租人的原租赁合同为基础,加之转租人与次承租人达成的合意以及原出租人对转租的承认结合在一起,形成的一种特殊的租赁关系。在转租法律关系中,存在着出租人与承租人之间的原合同关系、转租人与次承租人之间的转租关系、出租人与转租人的三种相互联系的法律关系。在这三个法律关系之中存在着出租人、转租人以及次承租人的利益平衡问题,如何衡平这几种利益关系,是稳定和繁荣房屋租赁市场成为法学界和司法实践部门共同关注的问题。Subleasing is based on the original lease contract of sub-tenant and the lessorS, coupled with agreement between sub-tenant and sub-lessees, as well as to achieve the desired recognition of the original lessor and sublease, it forms a special lease. In the sublease legal relationship, there is an original contractual relationship between the lessor and the lessee, sublet relationship between sublease and sub-tenant, three interrelated legal relationship between the lessor and the sublessor . In the three legal relationships, there is an issue about balancing the advantage among the lessor, sublessor, and sublessee, how to balance these advantages is an important question for juristic and judicial practice department which, to stable and prosperity the housing rental market.
