摘　　要：对我国沿海地区和中部地区某法院的民商事立案审查进行调研,结果显示:民事立案审查制度的实践功能与预期功能存在一定程度的背离。虽然不予受理的民商事案件在总受理的案件中所占比率较低,但以权力为中心的立案审查程序,反映了法院对审判利益的考虑超过了对当事人诉讼权利的关怀。为了平衡和制约法院的立案权力,应当立足我国现实条件,构造一个权力技术和权利技术兼容并蓄的,具有开放性的立案审查程序。The censorship of accreditation of civil and commercial case of two courts （one is representative of coastal areas,and the other is a central regions one）has been researohed in the paper.The results show that the practice functions of censorship of accreditation have run away from the anticipative system one to some degree.Though the percentage of the inadmissibility of civil and commercial cases is low correspondingly,the mode that as the center of power to censorship of accreditation has reflect that the people＇s court considering trail interests more than parties＇ rights.In order to balance and constraint the censor-power,we should construct censorship of accreditation＇s procedure which can contain power and right technology together basing on actual conditions.
