摘　　要：从法理的视角对事实问题进行分析,在借鉴两大法系合理因素的基础上能明确我国司法审查强度的模式选择路径。立足本国司法实践,对事实问题采取有限的审查态度,根据事实问题的不同性质,应采用灵活的审查标准。Analysis on the issue of fact from visual angle of legal principle,point out the pattern choice of our country on the basis of using Rational factor of the two legal systems. Have a foothold in homeland, takes limited examine attitude to the issue of fact, according to the different character of the issue of fact, we should set flexible standards to it.
