论民国时期基层法院判决依据的多样性——以浙江龙泉祭田纠纷司法档案为例

摘　　要：祭田纠纷是极具中国特色的民事法律纠纷。以民国龙泉法院司法档案中的数十份祭田案件判决书为样本,从实证和法理两个层面分析其判决依据,认为民国时期基层法院援引的判决依据具有多样性。结论是外来法和传统民事习惯的磨合有一个自上而下的脱节过程。The dispute over offering sacrifice to land is a civil legal dispute with Chinese characteristics.This thesis takes tens of written judgments of such disputes from the judicial files in Longquan Law Court as study samples,and analyzes the verdict bases from two levels-demonstration and legal theory.It comes to the conclusion that the verdict bases cited by the basic level court in the Republic of China (1912-1949) are diverse,and there exists a superincumbent disjunction between foreign laws and traditional civil practice.
