摘　　要：法律是表达某种价值取向的精神载体,无论是刑法的立法制定、司法运作,还是行刑执行,均应摒弃违宪性流俗,彰显正当的基本法精神。而非犯罪化、刑事和解与假释的完善是外在指征,人权、公正和效率是入宪性的刑法精神应有之义。The law is the spirit of vector,it is the value of the orientation,abandon the unconstitutionality,demonstrate the spirit of the basic law.Constitutional development of the criminal law and functioning of the judiciary and implementation of the execution,should be written into the constitution.Decriminalization and victim-offender mediation and parole perfect is important correction,human right and justice and efficiency is the spirit of the criminal law with the constitution.
