摘　　要：大学是崇真、向美、求善之领地,大学是国民教育之"象牙塔";现代大学治理是法律维度下的治理,是以章程为制度载体的治理。章程乃大学之"宪法",其演绎着校内行政权力与学术权力的博弈,折射着高校与政府、社会、师生的良性秩序和谐。大学章程是"组织法",更是"权利法"与"程序法";通过章程的现代大学治理是"校长治校"与"教授治学"之耦合,是学术自由与人权保障之凸显,是实体法治与程序法治之统一。University is the very place of seeking truth.It is well-known as the ivory tower of national education.Modern university governance is under the rule of legal dimersions and it is the rule of system which is based on charter. Charter is the＇constitutional law＇of an university.It reflects the conflict between administrative and academic powers and indicates the harmony of interior order,just as the relationship between school,society and governmment,students and teachers.Charter is not only a＇law＇ of organization but also a＇law＇of rights and procedure.The ruling by charter is the combination of president＇s administarative management and professor＇s academic governance,it give prominence to academic freedom,protection of human rights,entitative and procedural rule of law.
