摘　　要：能够认识到2002年的举证责任倒置为医院提供免责机会的人不多,至今许多医师还无法接受,2010年7月将要实施的《中华人民共和国侵权责任法》对医疗机构和人员实施严格责任,更是要引起困惑,必须引起重视。太阳要升起,医院要开办,医师要救死扶伤,必须尽快适应《侵权责任法》的相关规定。Tort Law of the People＇s Republic of China will be carried out in July 2010. Eleven items in the Tort Law are for the medical injury. They shall require the strict liability for medical injury. So far, a few doctors are still unable to understand and accept the burden of proof putted into practice in 2002. These doctors will be more trouble and suffering to work in the Tort Law. Earth is still turn. Sun rises. Hospital is opened. Doctors heal the wounded and rescue the dying. So, we must adapt to the Tort Law.
