摘　　要：抵押权实现方式对抵押权功能的发挥起着至关重要作用。自力实现应成为主要的抵押权实现方式。从自由、效率和公平的角度看,我国《物权法》存在一定缺陷。我国应允许当事人自由签订流押契约,赋予抵押权人占有抵押权的权利,引入强制管理制度,充分发挥抵押权自力实现方式的优越性。The ways of realization of mortgage play a vital role in fulfilling its functions.Among these ways,the self-realization of mortgage should be the main one.From the perspective of liberty,efficiency and justice,there still exist some serious flaws in China＇s ＂Law of Property＂.To improve the self-realization of mortgage,we shall allow the parties to sign flow escort contract freely,give mortgagees the right of possession of collateral,and introduce the system of compulsory management.
