医疗机构“紧急救治权”存在的问题及思考

摘　　要：本文根据当前法律法规中关于医疗机构"紧急救治权"的相关规定,分析了医疗机构行使"紧急救治权"的原因,以及紧急情况下的患者"不知情"或"知情不同意"以及医疗机构行使"紧急救治权"面临的风险。提出"紧急情况"的判定、"紧急救治"行为正当性与风险归属该如何应对的思路。建议完善相关法律和制度,建立强制医疗保险制度以及完善"紧急救治"的医疗救济制度。Through reviewing the regulations on the right of emergency treatment of hospitals,we analyzed reasons of emergency treatment of hospitals,including uninformed patients and informed patients without consent in emergency situations,as well as the risk of emergency rescue of hospitals.We put forward how to consider the judgment of emergency situations,justification of emergency treatment of hospitals,and risk attribution.We suggested improving the related legislation and regulations,developing compulsory medical insurance and a medical rescue system on emergency treatment.
