撒拉族婚姻习惯法与我国《婚姻法》的冲突与调适——以青海省循化撒拉族自治县街子镇为例

摘　　要：我国56个民族,风俗各异,婚姻习俗亦有所不同,各有其特色。少数民族习惯法,尤其是宗教习惯法在少数民族婚姻中起着无可替代的作用。加强对少数民族婚姻习惯法的研究,有助于深刻把握民族地区"活的法律",尊重少数民族的文化传统,吸收其积极因素,对推进民族地区的法制建设与社会进步意义深远。目前国内对于撒拉族传统婚姻习俗的研究较多,但是将撒拉族传统婚姻习惯法与婚姻法结合起来进行对比研究的还是相当之少,通过对民族习惯法长时间影响的民族地区就我国《婚姻法》的适用状况做了相关调查,探讨了撒拉族婚姻习惯法与我国《婚姻法》的冲突并寻求调试的方法。The study on the problems of marriage can be traced to the origin of marriage.There are totally 56 nationalities in our country,with different marriage customs.The customary law of minorities,especially the religious customary law plays an indispensable role in the marriage of minorities.To strengthen the study on marriage customary law of minorities is beneficial for the understanding of the law;to respect the traditional culture and take in the positive elements will exert a great impact on the improvement of legal system and the advancement of society.The researches on traditional marriage law of Sala account for a large number,but relatively less on the combination of traditional customary law of marriage and marriage law.In order to learn about the applied situation of the ＂Marriage Law＂ in ethnic places with long time influence of the ethnic customary law,this paper makes ＂A survey on the marriage customary law of Sala and the applied situation of that＂ to explore the conflict between the marriage customary law of Sala and the marriage law and to seek for the method of mediating.
