摘　　要：我国的医疗保险法律制度在建立、发展和改革过程中,取得了长足进步,同时也遇到了难以解决的问题。在现代金融危机和《社会保险法(草案)》征求意见的背景下,文章对我国的医疗保险制度进行了法律审视与思考,提出了现行医疗保险制度面临的根本性难题,并就进一步完善我国医疗保险制度和加快立法化进程提出了相应对策。Our medical insurance legal system has made considerable progress,but also en-countered difficult problems in the establishment,development and reform process of medical insur-ance.In the modern financial crisis and under the background of ＂Social Insurance Law（Draft）＂ to seek the views,the paper takes the legal review and consideration on China＇s medical insurance le-gal system,and proposes that the current health care insurance system faces a fundamental problem,and also proposes countermeasures on the process of legislation to further improve our health care insurance system.
