摘　　要：食品安全关乎公众的生命和健康,食品安全问题是各国政府所共同关注的重大社会问题。当前,我国食品安全问题凸显,违法犯罪频发。然而,由于立法衔接不到位、以罚代刑、检察机关监督不力、执法者认识偏差等原因,阻碍了食品安全案件行政执法和刑事司法的有效对接,从而抑制了刑法的惩罚犯罪功能的发挥。维持和改善食品安全状况,必须从立法和制度两个层面展开,建立相应的完善机制。As food safety attaches close contact to the public’s life as well as health,the issue of food safety is a major social problem commonly concerned by each state’s government.At present,the food safety problems are pretty highlighted in China,and relevant cases of lawbreaking and crimes frequently take place.However,the fact of incomplete legislation convergence,replacing punishment with imposing a fine,poor supervision of procuratorial organs,windage of law executors,and so on,has hindered the effective convergence of criminal justice and administrative law enforcement of food safety cases,which suppresses the play of criminal law’s function of punishing crimes.This paper argues that complete policies are supposed to be established from the two levels of legislation and systems,serious lawbreaking and criminal behaviors of food safety ought to be beaten,so as to maintain and perfect food safety.
