摘　　要：我国对行政救助的理论基础研究不充分而且存在着一些误解。行政救助是实现制度正义的必然要求;生存权保障是行政救助的权利基础,生存权的性质、内容和特征决定了行政救助是实现生存权的重要手段;行政国家下行政权更加能动和积极,可以用行政立法、行政决策等形式全方位地参与到行政救助的规则制定和实施的过程中去。因此,应把正义理论、生存权保障理论和行政国家理论作为行政救助的理论基础。Administrative assistance theoretical foundation should be studied because the research on it is weak and having problem existed.Administrative assistance is necessary for implementing the Institutional justice;Survival right guarantee is right base of administrative assistance,administrative assistance is the important means because of the property and content of survival right.The administrative power under administrative state is more positive and can all-round participate the process of making and implementation of administrative assistance rules by legislation of administrative assistance and the power of administrative decision of administrative assistance.The administrative assistance theoretical foundation should be composed of justice theory,the theory of survival right guarantee and the theory administrative state.
