摘　　要：非物质文化遗产知识产权的法律保护模式是非物质文化遗产知识产权有效保护的基础。由于非物质文化遗产内容的复杂性和独特性,非物质文化遗产知识产权的法律保护在理论体系和保护模式上存在激烈争论。比较分析非物质文化遗产知识产权的知识产权法保护模式和特别法保护模式的变迁,对科学构建非物质文化遗产知识产权法律保护模式的正当性、充分性、有效性具有重要意义。non-material cultural heritage model of legal protection of intellectual property rights of intellectual property rights and efifective protection of intangible cultural heritage foundation.As the complexity of the contents of the intangible cultural heritage and unique,intangible cultural heritage protection of intellectual property law system and in theory there is intense debate on the protection mode.Comparative analysis of the Intangible Cultural Heritage Protection of intellectual property law intellectual property law protection model and the model changes,the intangible cultural heritage on the scientific construction of the legal protection of intellectual property rights model of legitimacy,adequacy,effectiveness is important.
