摘　　要：由于高科技证据材料所具有的特点,其容易造成在实体方面认识论常规错误的发生,以及程序方面剥夺被追诉人程序权利的危险,有鉴于此,应当在证据能力和证明力之外建立证据"可反驳性"的新属性,以防止上述危险进入刑事诉讼程序。Due to the inherent attribute of high-tech evidence material, epistemological error in the aspect of substance and the risk of deprivation of procedure right are likely to be caused. Therefore, a new attribute ＂rebuttable＂ of evidence should be established beyond the evidence capacity and proof force in order to prevent that risk.
