施工合同计价条款存在的缺陷分析

摘　　要：合同缺陷产生的原因主要有两方面:一方面是施工合同示范文本存在的缺陷,导致施工合同在通用条款方面存在欠缺与矛盾。另一方面是合同当事人没有就专用条款进行仔细的协商与考虑,导致专用条款存在不完备、不具体的问题。这两方面的问题构成了施工合同的缺陷。施工合同计价条款中存在缺陷主要表现在以下方面:工程量清单不准确;未规定工程量的测量标准;未规定竣工结算纠纷的范围;工程进度款支付比例过低;竣工结算款支付时限的规定不明确。The main cause of defects in the contract has two aspects： one is defect in the construction contract（model text）,it leads to the lack and contradiction in the General Terms.The other hand contract parties have not negotiate and consider carefully with each other about special provisions that make it unspecific or indeterminate.These two issues constitute defects in the construction contract.Defects in construction contract price terms includes the following areas： the Bill of Quantities is not accurate;the standard of quantities measurement does not been provided;the scope of final account dispute does not been provided;the proportion of progress payment is too low;time limitation on payment of final account is not clear.
