摘　　要：近20年来,以张晋藩先生为代表的一些中国法律史学者,对清代律学展开了卓有成效的研究,其核心内容涉及律学抑或法学、律学的研究对象、律学的基本特色、律学的成因考掘等论题。其中,传统中国的律学与法学之间的关系,成为学术界讨论的热点问题之一。主张传统中国也有法学的论断,实际上是一种典型的"辉格式历史解释"的必然结果;而认为传统中国没有法学只有律学的看法,则是一种典型的"反辉格式历史解释"的逻辑结果。虽然传统中国律学与西方(现代)法学之间存在着根本性的差异,属于两种绝然不同的文化的产物,但是这并不妨碍我们承认传统中国律学也是一种法学的判断。而在法学家族中,曾经产生过多种不同模式"复数"的法学,其中既有西方范式的法学,也有传统中国范式的法学。重要的是如何描述传统中国律学的基本面貌,揭示它的独特品格,考究它的历史成因,从而"超越西方,回归本土",进入并理解传统中国的律学史或法学史。In the last twenty years, represented by Mr. Zhang Jinfan, some scholars of Chinese legal history have effec- tively researched on the studies of Qing Dynasty. Their researches involve the subjects such as the relationship of law study and jurisprudence, the objects of law study, the basic features of law study, the origin of law study, and so on. Among the above subjects, the relationship of law study and jurisprudence in traditional China is one of the hottest issue in the field. To assert that there is a jurisprudence in ancient China is an inevitable conse- quence of typical Whiggish’s interpretation of history. The opinion that there is only the law study, but not the jurisprudence, in ancient China that is a corollary of typical antiWhiggish’s interpretation of history. Although there is some essential difference between the traditional Chinese law study and the modern west jurisprudence, which belongs to the outcomes from totally different cultures, so we cannot be hindered by it in recognizing that traditional Chinese law study is also a kind of jurisprudence. There are various modes of jurisprudence, included western paradigm and Chinese paradigm. It is important to describe the features of Chinese law study, to reveal its characters, and to observe its origins. Accordingly, we should exceed the west and resume the native, so as to understand better the history of law study and jurisprudence in traditional China.
