摘　　要：刑讯逼供是公安机关在执法中难以治愈的顽症。它有悖于诉讼文明和司法民主的现代性要求,是依法治国、建设社会主义法治国家主旋律中的不和谐音符,既不利于打击犯罪也损害了司法公正。在国际社会反对酷刑、强化人权保障的今天,随着"法治"话语在我国刑事诉讼"场域"的不断展开,刑讯逼供已经成了一个"不可忽视"的问题。文章从关注公安民警的思想意识着手,分析了传统法律文化和思维哲学对其产生的消极影响,并在该基础上提出了相关的治理对策。Torture is difficult to cure the chronic problem of law enforcement.It is contrary to civilization and judicial proceedings requirements of modern democracy,and is the disharmony element to the rule of law and building a socialist country ruled by law,is not conducive to the fight against crime also undermines justice.Today,under the situation of against torture and the international community ＇ s strengthening protection of human rights,with the ＂ law ＂ discourse in the Chinese Criminal Procedure ＂ field＇s ＂ constantly expanding,torture has become a ＂ can not be ignored ＂ problem.This paper concerns the ideology of the police,analyzes the philosophy of traditional legal culture and mentality of its negative impact on the basis of relevant countermeasures proposed.
