摘  要:目前,图书馆自助寄存柜纠纷还不能从现有的图书馆法律体系中找出直接的依据,但图书馆与读者之间存在民事法律关系,图书馆自助寄存柜纠纷可受《民法通则》、《合同法》的调整。从图书馆自助寄存柜的性质和交付行为来看,图书馆自助寄存合同的法律性质应认定为借用合同,图书馆作为无偿出借人对受益人承担较轻的义务和责任。但图书馆仍应加强对自助寄存柜的管理,使图书馆的人性化服务落到实处。The library self-service locker disputes can't find out relevant regulations from the existing legal system of libraries. But the civil legal relationship exists between the library and the reader, so the library self-service deposit disputes could be governed by the general rule of the civil law and the contract law. From the nature of the library self-service locker and delivery behavior, the legal nature of the library self-service locker contract should be deemed to the loan contract. As free lenders, libraries should not take the overweight responsibilities and obligations. However, the library should strengthen management of self-service locker so that the humanistic service is practicable.
