摘 要:有效规制企业非破产清算中的劳动关系处理问题,有利于建立和谐的劳动关系,有利于劳动权益的保护,特别在发生金融危机或者其他重大经济事件的情况下,有利于企业与劳动者双方利益的平衡,制止恶意逃逸现象。我国企业非破产企业清算中对劳动关系的处理存在法律责任不清、规定过于原则和笼统等问题。应当建立强制清算制度,将恶意不清算行为纳入刑法规范范围,并从有利于保护劳动者权益又能平衡企业和双方利益角度确立清算中的劳动关系处理规范。It is propitious to establish harmonious labor relations and protect labor rights and interest,if the problems of labor relations in non-bankruptcy accounting of corporation be regulated effectively.Especially in condition of financial crisis,it is propitious to balance the interests of labor and corporations,and to determent the phenomenon of corporations malicious escaping.In the settlement of labor relations of non-bankruptcy accounting of corporation in China,there are some problems such as unclear legal liability,too principle regulations and so on.We should establish the compulsive system of accounting of corporation,and bring the malicious escaping into criminal law.We must set up the system of dealing with labor relations in non-bankruptcy accounting not only protecting labor rights but also balancing the interests of laborers and corporations.
