摘　　要：商业贿赂行为发生的特点决定了打击商业贿赂行为仅靠国家强力是不够的。商业贿赂带有的"潜规则"性决定了对其治理应该采取刚性和柔性两种手段的结合。加强商业贿赂的民间治理,能在一定程度上弥补商业贿赂国家治理的不足。只有两种治理方式的结合,商业贿赂的治理才能达到标本兼治的目的。Commercial bribery cases prove that state power alone lacks effectiveness in the fight against them.Therefore,it is quite necessary to combine the rigid government＇s controlling and the flexible civil governance to combat the ＂unspoken rules＂ present in business competition.Strengthening civil governance will provide a way to make up for a deficiency in state governance.Only by integrating the two strategies can the temporary solution and the permanent cure be achieved for curbing the misconduct.
