“村权三分,三会村治”治理机制思考——对江苏海州模式的考察

摘　　要：《村委会组织法》中规定了四大民主:民主选举、民主管理、民主决策和民主监督。民主选举理论研讨与实践探索较充分,而另外三项民主:民主管理、民主决策和民主监督的贯彻和落实却是一道棘手的难题。介绍了连云港海州区"村权三分,三会村治"(三权:决策权、管理权和监督权;三会:议事会、村委会和监事会)机制的产生、运行机制、效果与存在的困难和问题,运用治理理论与分权理论进行了学理分析,并提出了思考。Organic Law of Villagers Committees prescribes four democracies,namely,democratic elections,democratic management,democratic decision-making and democratic supervision.There are plenty of practices and theoretical studies on democratic election,while the implementation of other three democracies is quite a complicated problem.Here introduces the generation,operation,effect,difficulties and problems of ＂Separation of Three Powers＂ and ＂Rule by Three Committees＂ mechanism（three powers refer to decision-making,management and supervision;three committees refer to council,village committee and the board of supervisors） in Haizhou district of Lianyungang,and then a theoretical analysis is conducted on its governance and power separation theories,and finally the some considerations are proposed.
