调职法律问题初探

摘　　要：近年来,我国用人单位与劳动者之间的调职争议频发,但有关调职的立法与研究却相对匮乏。结合具体案例,对调职的类型与法律性质进行分析是深入研究调职法律制度的前提。在此基础上对我国现有的调职立法进行评析,从而有利于更加公正、合理地解决调职法律问题。In recent years, transfer disputes between employers and employees happen frequently, but our country is deficient in the legislation and research about transfer. With specific eases, the analysis of transfer type and legal nature is the prerequisite of research on transfer legal system in depth. On this basis, we need make comments on our country＇ s existing transfer legislation. Consequently, transfer legal questions can be resolved more fairly and rationally.
