摘　　要：民事证明责任分配的价值,既要考虑民事实体法的价值准则和立法目的,又必须围绕民事诉讼制度的自身规律与内在要求,在价值取向上应当遵循程序公正优先原则、最大限度地保障实体公正原则和符合诉讼经济原则。The value of burden proof in civil procedure should not only think on the rule and legislative aim of civil substantive law,but also obey the following principle：procedure fair and priority,substantive justice and economic litigation.
