摘　　要：作为一项外来制度,情况判决在中国的情境之下生存状况如何,需要系统的反思。在案例分析的基础上对我国情况判决的适用状况进行实证分析,审视情况判决的适用现状,分析其存在问题,并对几种流行的改良情况判决制度的方案进行点评,具有不可忽视的现实意义。Being an exotic system,circumstance judgment needs systematic reflection before being applied to China.This article is such an empirical analysis basing on cases that it studies in due order the application status quo,the existing problems and several popular improvement schemes.
