经济法生态化本体论范畴探析

摘　　要：为了应对全球生态危机、经济危机,作为上层建筑的法律如何作为?法律界提出了法律生态化的主张。经济法作为国家管理经济和协调经济运行的法律,经济法生态化本体论应如何构建?从法律生态化的概念入手,剖析了法律生态化两大传统学说即立法理念说和趋势说,考辨了范畴与范式等法哲学概念,提出了法律生态化本质是一种范式,经济法生态化是一种范式选择,以期对经济法生态化本体论研究做出一定贡献。Facing the world-wide ecological and economic crises, how should law, as the superstructure, cope with them？ The academic community has called for an ecological law. As the state law of managing economic affairs and coordinating economic undertakings, how should the ontology of the ecological economic law he constructed？ Beginning with the concept of the ecological law, this article has analyzed two main traditional theories, that is, the theory of legislative idea and its trend, put forward that the essence of the ecological law is a pattern and the ecological economic law is an option upon it, and then vindicated and interpreted what category or pattern it really is. It has also integrated the theo- ry of sustainable development into the category of the economic law ontology, for the purpose of contributing to the study on the ontology of the ecological economic law.
