关于建立我国社区矫正官制度的思考

摘　　要：我国的司法行政部门一直以来都是我国监禁刑执行的主管机关,司法行政机关参与领导和管理社区矫正无法律依据,社区矫正工作人员无执法主体资格。建立社区矫正官制度,是以社区矫正官为中心,广泛动员其他社会资源参与社区矫正,既保证了社区矫正的刑罚执行性质以及刑事司法机关对社区矫正工作的领导,又解决了社区矫正地域相对分散、人力资源相对不足的困难。Our country＇s judicial administrative department has been managing organs of imprisons punishment execution in our country,the judicial administrative organ＇s participation,leadership and management in ccommunity correction has non-legal basis,the community correction staff has not law enforcement main body qualifications.To establish community correction official system,to take the community correction official as the center of community,widely mobilizes other social resource participation community correction,both can community correction the community correction execution of punishment,as well as community the leadership of the justice institution in community correction work,also can solve the community correction region relative dispersion,the human resources relatively insufficient difficulty,so it has unreplaceable superiority.
