摘　　要：公正审判权是宪法性基本权利。与其他国家宪法关于公正审判权的规定相比较,中国宪法对这项基本权利的规定存在很多缺失。为适应和谐社会对公正司法的要求,我国有必要将公正审判权确立为宪法性基本权利。The right to fair trial is one of the basic rights stipulated by the constitution.Compared with the stipulations about the right to fair trial in other countries＇ constitutions,there are a lot of deficiencies in China＇s constitution.In order to meet the requirements about the judicial justice of harmonious society,it is necessary for China to stipulate the right to fair trial as one of the constitutional basic rights.
