摘　　要：委托调解制度在践行过程中由于相关立法的缺位而暴露出一些问题影响了该制度的运行效果。合理界定委托调解的适用范围既是规范委托调解制度运行的前提,也是发挥委托调解在纠纷解决机制中应有功能之关键。为了促进多元化纠纷解决机制和谐而高效运行,宜在总结实践经验的基础上,根据委托调解在纠纷解决机制中的地位与自身特质来规范委托调解的适用范围。Commission-mediation system in practice has revealed some problems affecting the functioning of the system because of the absence of the relevant legislation.The reasonable definition of the scope of commission-mediation system is not only the premise of commission-mediation system but also is the key to the system to function well.In order to promote the diversified mechanism of dispute resolution running harmoniously and efficiently,the legal norm of the scope of application of commission-mediation system should be perfected according to its own functions and features of mediation and on the base of practical experiences.
