摘　　要：我国《民法通则》和《合伙企业法》都对合伙财产作出了规定,但对合伙财产的法律性质均采取了回避态度。本文从探究共有的两种形态入手,结合各国对合伙企业财产法律性质的规定的法律沿革和我国的相关法律规定,对合伙财产法律性质作了一定的界定。China＇s ＂Civil Law＂ and ＂Partnership Enterprise Law,＂ made all the provisions of the partnership property,but took an evasive attitude about the legal nature of the partnership property.It has been a widely controversial issue on the nature of the partnership property for the scholars.The author shared from the two forms of inquiry,combining national legal nature of partnership property under the legal history,and China＇s relevant laws and regulations,attempts to define the legal nature of partnership property.
