网络故障损失赔偿责任的理论分析

摘　　要：随着计算机和网络技术在社会生活中的广泛应用,互联网已成为人们生活、工作的重要媒介。当网络因各种原因出现故障的时候,无可避免地会给人们带来各种各样的损失。随着这种损失覆盖面的日益扩大,相应的责任承担及损害赔偿问题逐渐引起人们的关注。目前解决方式只是由网络接入服务商对故障网络尽早修复,但因此产生的经济损失只能由用户自己承担,理由多为不可抗力。笔者对此提出了自己的看法与意见。With the wide use of computer and internet in social life,internet has become an important media for life and work.Any network failure unavoidably leads to various losses.The increasingly great loss arouse people＇s concern over corresponding responsibility and indemnity matters.The present solution is Internet service providers repair the fault network as early as possible,but users have to bear the loss,as it is considered as force majeure,on which the author puts forward views.
