自主创新战略下我国技术市场地方立法检视

摘　　要：技术市场的发展有利于我国自主创新战略的实施,而技术市场的发展需要完善的法律规范作指引。目前我国没有对技术市场予以国家立法,地方性技术市场条例成为规范技术市场活动的主要规章。通过梳理现存的地方技术市场相关法规,对各地技术市场条例中存在的若干问题进行了具体分析,如对条例的适用范围、技术交易行为的规范、技术交易的禁止行为、违法行政责任等基本问题缺乏明确规定。The development of technological market will promote the implementation of independent innovation strategy which should be guided by the complete legal norm.By now there is no state law about technological market,and local regulations become the main rules which standardize the behavior of technology trading.But local regulations of technological market is lack of rules about some elementary problems,such as applicability of technological market regulations,standardization of technological trading,prohibition of technological trading and administrative responsibility of illegal act.The inspection on the local regulations of technological market will improve the local legislation,and eventually promote the implementation of the independent innovation strategy.
