法、德两国民事执行救济体系之比较

摘　　要：法、德两国的民事执行救济制度经过长期的发展演变,均已形成完整的民事执行救济体系。从执行救济的功能、层次以及立法技术等层面来看,两国民事执行救济体系存在不少类似之处,同时也存在着诸多差异当前,我国民事执行救济制度在体系结构方面仍然存在诸多缺陷,法、德两国在民事执行救济体系建设方面的经验无疑值得借鉴。With a long development,France and Germany have formed complete civil relief systems.There are many similarities between their civil relief system in the aspects of function,administrative level and legislative technology.However,there are also many differences between them.At present,there are many problems in Chinese civil relief systems,so the civil relief systems of France and Germany can provide a good reference for China.
