摘 要:《中华人民共和国劳动争议调解仲裁法》扩大了劳动争议处理受案范围,地方立法例细化了劳动争议处理受案范围,但中国劳动争议处理受案范围依然存在诸多问题,宜从三个方面展开改革:引入利益之争的调整事项、扩大权利事项的调整领域、厘清行政与仲裁、诉讼的界限。"People's Republic of China Labor Dispute Mediation and Arbitration Law" expands the scope of cases which should be accepted on the labor dispute.Local Legislation provides detailed rules for the scope of cases that can be accepted.However,there are still many problems on how to decide whether a case should be heard or not.I believe that the Reform measures should be taken in three aspects: First,to introduce adjusting events of dispute concerning interests;Second,to enlarge the adjustment area of issues about right;Third,to draw a clear distinction among the Administration,arbitration and litigation.
