大学生特殊群体体育权利保护的研究

摘　　要：体育权利是实现人们身心健康的权利,是一项基本人权。根据国际人权公约和各国残疾人保护法,以及各国立法的成功经验,结合我国高校特殊群体学生的体育教学工作实际,就保护特殊群体学生体育权利的问题,提出立法建议:建立特殊群体体育权保护法;完善体育权保护法律条文;制定配套相关法规;强化法律实施监督;加强普法教育活动。以进一步规范和完善大学生特殊群体体育权法律制度,确保特殊群体学生的体育权利能得以充分实现,使其获得身心的全面、协调、健康发展。The right to physical education is a basic human right which helps to promote human＇s physical and mental health.This article,based on international conventions on human rights,the laws on the protection of disabled persons enacted by various countries,the successful experience in relevant legislations in different countries,and China＇s practice in the PE teaching of Chinese college students with special needs,gives the following legislative suggestions on the protection of the right of college students with special needs to physical education： enacting a law on the protection of the right of those with special needs to physical education,consummating the current laws on the protection of the right to physical education,making relevant laws and regulations,intensifying the supervision of law enforcement,and strengthening the popularization of laws.All these suggestions are intended to further standardize and improve the legal system for the right of college students with special needs to physical education,ensure their exercise of their right to physical education,and help them attain all-around and coordinated physical and mental development.
