摘　　要：存款实名制下冒名存款纷争屡有所见,冒名存款行为性质、存款合同效力、所存款项归属等问题的探讨具有重要理论价值与实践意义。究其本质,冒名存款行为不仅是无效民事行为,更是对被冒名者姓名权的侵权行为;冒名存款合同的效力及款项归属不能一概而论,必须根据不同的案件事实予以确定。Impersonate deposits disputes under deposit real-name system can be seen frequently.And issues about the character of impersonate deposit behavior,the effect of deposit contract and the ownership of the deposit are of great theory value and practical significance.The essence of impersonate deposits behavior is not only a kind of invaild civil action,but also a kind of infringement behavior that infringe the imposter namer right.The effectiveness of impersonate deposit contract and the problem that who owe the money cannot treat as the same,must be identified according to different cases.
