摘　　要：社会秩序对于一个国家的存在与发展来说固然是必不可少的,但是如果人们过度崇尚用刑罚的强制力保障秩序,忽视伦理在预防和控制犯罪方面所起的广泛的、深远的作用,那么再严密的刑事法律和政策在犯罪浪潮面前,只能力不从心。因此国家刑罚权的实施应建立在伦理价值的基础上,做到最少的刑罚维护社会秩序,并最多地保留个人自由领域,力求自由和秩序的合理平衡,实现正义价值。Social order is of great importance to the existence and development of a nation.If the criminal penalty is excessively emphasized and the far-reaching effect of ethics in preventing and controlling crimes is ignored,criminal law and policy will become inadequate to the prevention of the crime wave.In this sense,a nation＇s power of punishment must be based on the ethics so as to enforce less criminal penalty but to guarantee more personal freedom.In so doing,it is hoped that a balance between freedom and social order will be properly established and the value of justice be maintained.
