学校体育伤害事故法律责任的探析——论大学生与中小学生的区别

摘　　要：大学生参加体育运动发生伤害事故的现象屡见不鲜,目前我国学界对学校体育伤害的探索与研究颇多,但往往把大学生的学校体育伤害和中小学生混为一谈。本文通过对学校体育伤害若干基本理论问题的分析,对比大学生与中小学生学校体育伤害处理方式的区别,进而提出了针对大学生学校体育伤害处理的归责原则。It is common for undergraduates to have accident sports injury.At present,there are lots of exploration and research on this topic.But the educational circles often jumble sports injury of undergraduates with that of school students together.This article,through analysis on the basic theory of school sports injury and comparing the difference of process modes between undergraduates and school students,proposes the criterion of liability for sports injury of undergraduates.
