摘　　要：管理人制度是新破产法中全新的制度,这注定其还有待完善。清算组担任管理人要严格限制条件,未来管理人的选任应以竞争方式为主,应创设破产基金作为管理人报酬的保障,管理人责任体系尤其是民事赔偿责任的构成要件要明确化,要成立一个统一的管理人协会,发挥对管理人的制约功能。As a brand-new system,the bankruptcy law,the bankruptcy manager system remains to be destined to improve itself.The conditions for liquidation group for a bankruptcy manager should be strict,and the selection of future bankruptcy managers should be built on a competitive basis.Bankruptcy funds should be created as payment protection of bankruptcy managers.Manager responsibility system,especially the composition of the civil liability,must be clear.It is necessary to set up a unified bankruptcy manager association,which will play a role in constraining bankruptcy managers.
