摘　　要：国家工作人员应当包括所有依法从事国家公务活动的人员,应当把"身份"和"职权"有机地结合起来进行判断。国有公司、企业中的国家工作人员仅包括资本金全部为国家所有的公司、企业,而不包括国有控股或参股的公司、企业。The state functionaries in criminal law in China shall include all missions of the staff engaging in the official business according to law,we should put ＂identity＂ and ＂authority＂ organically for making judgments.The government-owned corporation or enterprise includes only the capital for the state of all companies and enterprises of all,not including state-owned company,enterprise or equity.
