摘 要:黑格尔的契约思想是值得我们关注的。黑格尔认为契约是平等主体之间建立在相互意见一致的合意基础之上的协议,契约充分肯定了人的自由和平等,契约使人从等级特权的人身束缚之中解放出来,契约使个人的才能得以施展,使人的个性得以倡扬,从而使社会充满了活力,因而契约具有历史的进步性。不过,契约平等具有形式平等与实质平等两个维度。由于契约能力等原因,契约形式平等背后可能隐藏着契约的不平等,这是我们必须要加以注重的与预防的。我们不能仅仅局限于、满足于契约的形式平等,我们应关注契约的实质平等与社会的实质平等。We should learn more about Hegel's contract notion because there are many valuable thoughts in it.The contract is,according to Hegel,the unanimous agreement made between equal subjects on an all-pleasing foundation.The contract is a full recognition of human freedom and equality.The contract frees people from the manacles of class privilege.The contract brings into full play individuals' talents.The contract promotes individuality and fills society with vigor,thus boosting historical progress.However,contract equality has two dimensions: formal equality and essential equality.We have to be cautious and prevent the likely inequality of contract concealed in formal equality,which might be caused by contract inability and the like.We should seek not only the formal equality of the contract but also its essential equality,and the essential equality of society.
