连累犯基本问题探析

摘　　要：连累犯是在本犯既遂以后参与其中,和本犯有着密切联系的事后帮助型犯罪,具有法定性、事后性、依附性、明知性和助长性的特征。对连累犯和本犯的关系,以及连累犯的构成要件,应该结合刑法规范所要保护的法益内容进行解释和确定。Involvement offence is an afterwards assisting crime in which the offender plished crime and is closely connected with the original offender. It has characteristics participates in an accom- of statute, ex-post-factor, subordination, and characteristic of violating knowingly and fosterage. To explain and determine the relationship between involvement offence and the original offence as well as the constitutive requirement of involvement offence, it needs to integrate legal interest content protected by criminal law.
