高等院校防止利益冲突制度初论

摘　　要：利益冲突是权力腐败之源,防止利益冲突对于反腐倡廉建设具有重大意义。作为廉政概念的"利益冲突",是指公职人员由于受到其私人利益因素的干扰,以致价值判断和政策取向偏离公共利益要求,发生私人利益与其公职所代表的公共责任相冲突的情境和行为。从利益冲突的概念入手,简要回顾国内外防止利益冲突的制度实践,分析高等院校利益冲突的现状和防止利益冲突方面存在的问题,进而揭示建立健全高等院校防止利益冲突制度的意义,最后就如何建立健全高等院校防止利益冲突制度提出一个初步框架。Interest conflict is the origin of power corruption. To prevent interest conflict is meaningful to the fighting with corruption and the building of a clean government. ＂Interest conflict＂, as a concept of clean govemment, means that the government official may produce a situation and conduct where his pensonal interest is in conflict with the public duty of his government service, because he may be troubled by his personal interest, and may have a wrong value judgment and a wrong policy orientation against the requirements of the public interest. This paper begins with the concept of ＂interest conflict＂, makes a brief review of the system practice in China or abroad to prevent the interest conflict, analyzes the present situation of interest conflict at colleges and the problems in preventing it, and further explores the significance of improving the prevention system of interest conflict at colleges. And it also puts forward a preliminary frame of the prevention system of interest conflict at colleges.
