时间浪费与损害赔偿——以旅游合同为例

摘　　要：旅游以时间为要素,没有时间就没有旅游。对于可归责于旅游经营者之事由而造成的时间浪费,旅游者有权要求损害赔偿。时间浪费损害赔偿属于非财产损害赔偿的一种独立形式。时间浪费损害赔偿责任的成立,需要具备旅游挫败或者遭受严重的损害、旅游者已经浪费了时间、旅游者因旅游时间的徒过而受到损害等构成要件。旅游活动时间浪费请求权是一种债权请求权,这一请求权可以与违约精神损害赔偿请求权一并适用。Travel has to take time.There is no travel without time.Tourists have rights to claim for compensation in terms of waste of time due to the fault of travel operators.Compensation for waste of time belongs to a kind of independent form for non-property damage compensation.The responsibility for the compensation requires three elements of tourist frustration or serious damage,tourists having wasted time and tourists having been harmed because of missing tine.Claim for time waste during tourist activities is a right of creditor＇s claim,which can be implemented as the damage compensation for the breach of travel contract.
