摘　　要：法院对于证监会的规章制定行为和执法行为进行的司法审查是约束证监会权力规范行使的重要制度保障。司法审查需要探究两方面的问题:即司法审查的广度和深度,以此厘清司法审查权与证监会权力之间的界限;在此基础上通过分析我国证监会被诉案件的情况,指出目前司法审查的效率,并寻求导致司法审查失效的原因。Judicial review made by people＇s court aiming at CSRC＇s procedures for the making of securities and futures rules and performing acts is the important system guarantee which constraint CSRC to perform its power normatively.Study on judicial review should research two problems：the width and depth of it.By doing so we can draw a clear line of demarcation between the power of judicial review and the power of CSRS.On the basis of the above we analyze the situation of the alleged cases of CSRC and point out the efficiency of judicial review,then find out the reason for the judicial review not performing well.
