摘　　要：医疗损害和医疗侵权责任的认定在处理医疗纠纷中扮演着十分重要的角色。我国现有法律体系中关于医疗损害和医疗侵权责任的相关规定有待进一步厘定和完善。本文通过对医疗损害和医疗侵权责任等问题的辨析,以此提请医疗机构对医疗损害、医疗侵权责任和医疗纠纷的防范和规避。The medical-damage and medical-malpractice always represent themselves as importance in the hospital-patient dissension.The provision on the medical—damage and medical-malpractice in jurisprudence needs consummating and definition.In virtue of the differentiating and analyse on the medical—damage and medical-malpractice,I should bring forward the introduction on application in law,and bing up the elusion to the hospital from the hospital-patient dissension.
