关于日本行为共同说的反思

摘　　要：行为共同说以追求社会防卫为价值目标,主张以"共同行为"这一事实认定多数犯罪行为人之间的"共同性",在"行为"面不要求共同实施特定的犯罪;在"意思联络"方面,也不要求数人必须具有共同实现犯罪的意思联络。由于这一主张不符合现实生活中的共同犯罪的事实,从而不能科学地认定犯罪人之间在行为上何以共同性的问题。因此,日本行为共同说是值得反思的。The theory of common behavior pursues the value goal of social defense. It advocates that the judgment of ＂common- ness＂ among most criminals should be based on the fact of ＂common behavior＂. Moreover, in ＂behavior＂ , the common behavior theory does not stipulate the specific crime jointly exercised by most criminals. Meanwhile, considering ＂ idea connection＂, it does not mean that most criminals have idea connection to jointly commit crimes. Such a proposition does not conform to the fact of joint offence in reality so that it cannot scientifically identify why the criminals hold ＂commonness＂ in their behaviors. There- fore, there is much room for further rethinking of the common behavior theory in Japan.
